82. Henry Dawson ROBERTS was born on 25 December 1791 in Nelson Co, VA.^{439,440,441,442} According to the date calculator it should be 27 December 1791 - assuming that the death date is correct. He signed a will on 24 March 1856 in Putnam Co, WV.⁴⁴³ In the name of God Amen. I Henry D. Roberts of Putnam County and State of Virginia being sick and weak of body, but of sound and disposing mind, memory and understanding,considering the cernenity(sic) of death, and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence,do therefore make and publish this my last will and testament in the maner(sic)and form following, first, I will and bequeath to my wife Eliza B. Roberts all my affects, vis:  two negro women (Mary & Ginny) one negro man Tom, two negro boys (Edward & Fallas) and one negro girl, Grace, aged twelve months, and the increase of said negroes, and also all other species of property of which I am possessed at my death, to be by her held and controlled as her own during the time she remains my widow and of the event of her death or marriage another person said property shall descend to my children (viz:  Nathaniel Harden, William Granderson, Amanda (now consort of C P Brown) John Henry, Mildred Jane (consort of H G Roberts) James Mortiner, Anna Burton (consort of S B Bowyer) and Joseph Alexander,) when the youngest arrives at the age of twenty one, said property and its proceeds shall be divided equally among them, and if any of the before mentioned children die without heirs the share or shares of the same shall be divided between the survivors and in the event of the death of my wife before my youngest son arrives at the age before mentioned, I appoint my son James Morener his guardian until he, Joseph Alexander shall arrived at the before mentioned age (twenty one). It is also my will that James Mortiner take care and look over the interest of my widow, so long, as the said Eliza B. Roberts remains as such, or until my youngest son Joseph Alexander shall have arrived at the age of twenty one, when such charge shall devolve upon him, but in the event of the death of either of them, the charge shall devolve upon the living one, and if the charge devolve upon both separately as before mentioned (or upon only one) which could only result by the death of the other the same shall be paid a reasonable sum(out of the proceeds, interest or labor of the aforesaid property) for his or her trouble, to be estimated by the said Eliza B. Roberts, as she may deem most just & equitable.  The negroes and the increase of the negro women I wish to remain in the family, at least until the death or marriage of my widow, and she shall not have the power to dispose of the said negroes by sail(sic) or gift. To all of this and these I declare to be my will, and wish it to be consigned as my last will and testament and fulfilled accordingly.  In witness whereof I hereunto affix my name and seal, on this twenty fourth day of March in the year of our Lord one thousand eight hundred & fifty six.
                                                                Henry D Roberts (Seal) He died on 25 May 1856 at the age of 64 in Putnam Co, WV.^439,444 Henry was buried after 25 May 1856 at Bowling Cemetery in Putnam Co, WV.⁴⁴⁵ He had his estate probated on 22 November 1856 in Putnam Co, WV.⁴⁴⁶ At the Court of Monthly Session held for the County of Putnam at the Court House, on Monday the 22d day of September 1856, the last will and testament of Henry D. Roberts Dec’d was proved by the oaths of James Nounnan and James H Nounnan witnesses thereto and is ordered to be recorded, and time is given for appointment of Executors & C.
