11. John M ROBERTS was born about 1765 in Amherst Co, VA.106,107 He served in the military Private, VA Militia in 1807 in Virginia.124

Capt. John E ROBERTS was born about 1795 in Amherst Co, VA. He signed a will on 30 May 1847 in Nelson Co, VA.125 I John E Roberts do make and constitute this instrument of writing as and for my last will.
 
1st  It is my desire that my executor hereafter to be named shall out of the first monies that comes into his hands pay all my just debts and funeral expences(sic).
 
2nd  It is my desire that my brother Fountain Roberts shall receive five hundred dollars in cash out of my estate, which sum my executor is directed to pay him out of the first money that comes to his hands after the payment of my debts.
 
3rd  It is my desire that after the accomplishment of the above named objects, that the whole of my estate both real & personal together with all or any interest I may have in the estate of my deceased father or the estate of my deceased brother Milton T Roberts, shall be equally divided by three commissioners to be appointed by the County Court of Nelson in two parts, and that the children of my deceased brother Jeremiah W Roberts take one of those parts to be equally divided between all of the, and the children of deceased sister Elizabeth Durrett take the other part to be equally divided between all of them and their heirs.
 
Lastly I do appoint Wm Faber executor of this my last will.  Given under my hand this 30th day of May 1847.

Given under my hand this 28th day of July 1848.

Fountain Roberts, William B. Harris, guardian of John and Schuyler Roberts, the children of Elizabeth Durrett, viz, Ann, Eliza, Matilda, Margarett, John, Fontaine, Paul Silas and William Durrett.
In Chancery
The Defendants Ann, Eliza, Marietta, Margarett, John, Fontaine, Paul Silas, and William Durrett, children of Elizabeth Durrett, not having entered their appearance and given security according to the Act of Assembly, and rules of this Court and if appearing to the satisfaction of the Court that they are not inhabitants of this State: It is ordered that the said defendants do appear before the Justices of our County Court of Albemarle, at the Court House of the said County, on the first Monday in March next, and answer the Plaintiff's bill and that if copy of this order be forthwith inserted in the Jeffersonian Republican a newspaper published in the town of Charlottesville, for two months successively - and that another copy be posted at the front door of the Court House of this County.
