Zachariah "Capt Zack" ROBERTS was born about 1755 in Amherst Co, VA.150,151 He served in the military about 1780 in Nelson Co, VA.152,153 He served in the military Public Claims on 14 April 1783 in Buckingham Co, VA.154,155 156 157 158 159 On 26 February 1823 Capt Zack was a Justice of the Court of Nelson County in Nelson Co, VA.160 Know all men by these presents, that we William Faber, John Lyon, Reuben Martin, Terisha Turner, Terisha Bailey, & Henry Turner, are held and firmly bound unto Jesse Jopling, John C Cobbs, Zachariah Roberts & Michael Woods, Gentlemen Justices of the Court of Nelson County, now sitting, in the sum of Fifteen Thousand dollars...The condition of the above obligation is such that if the above bound William Faber, administrator of all the goods, chattels, and credits of James Thurmond decd do make or cause to be made, a true and perfect inventory of all and singular the goods, chattels, and credits of the said deceased, which ave a shall come to the hands, possession or knowledge of him the said William Faber, or in the hands or possession of any other person or persons form, and the same so made do exhibit it or cause to be exhibited in the County Court of Nelson at such a time as he shall be there...if the said William Faber being thereunto required to render and deliver up his letters of administration, approbation of such testament being had and made in the said Court, then this obligation to be void and of no effect, or else to remain in full force and virtue...At a Court held for Nelson County the 26th Feby 1823 : This bond was executed and acknowledged in open court, and ordered to be recorded. To the Honorable Lucas P Thompson Judge of the superior Court of Law & Chancery for the county of Nelson re:  the bill of complaint of Elliot N. Roberts of the county of Nelson.
 
Your Orator begs leave to represent that his father, Zachariah Roberts of the county of Nelson departed this life on the day of     in the year 1838 intestate leaving considerable property both real and personal estate.  He left his widow Sarah N Roberts & the following children his heirs and legal representatives, To wit, Mathew H, Skiler H., John H., Waddy W., Benjamin F, Sophia and Caroline Roberts and also a grandson, G. Washington Turner, a son of a deceased daughter Sally Turner,formerly Sally Roberts – That administration of the estate of his father to Waddy W. Roberts – Your orator does not suppose that the situation of the said estate, will require its being kept together any length of time, & that it will be important that the  ????? according ??????? at as early ??????  ble – To effect this your orator prays that the said administrator & the residue of the representatives may be compelled to answer the bill & say what reason there can be for deferring the division of the said estate and that an order of publication be recorded against Matthew Roberts, Skiler H Roberts who are no inhabitants of this commonwealth, & that a guardian ad litem be assigned to the said G. Washington Turner, who is an infant under 21 years of age, and that the Court would direct the according of the said administrator to be settle & the real & personal estate of his father to be divided according to law after first laying off the said widow her dower therein & to grant such others and further relief as in grant & right.

Zachariah "Capt Zack" ROBERTS and Sarah Netherland HARRIS were married on 24 October 1789 in Amherst Co, VA.165,166,167 They165,166,167 appeared in the census in 1820 in Buckingham, Nelson, VA.168 They168 appeared in the census in 1830 in Nelson Co, VA.169 Sarah Netherland HARRIS, daughter of Matthew HARRIS and Elizabeth TATE, was born about 1765 in Albemarle Co, VA.170

Benjamin Franklin ROBERTS was born about 1805 in Amherst Co, VA.163 I have no birth date - only an estimate. He signed a will on 24 April 1841 in Nelson Co, VA.171 I Benjamin F Roberts of the County of Nelson do hereby make this my last will and Testament.
First. I direct that all my just debts & funeral expenses be paid.
2nd I give to my sister Sophia E Roberts all my estate both real & personal, subject to the following exception of a girl names Selina.
3rd I give to my brother Waddy W Roberts my negro girl named Selina, and I appoint my said brother Waddy W Roberts Executor of this my last will & testament.
