This Indenture made and entered into this 19th day of September 1838 Between Richard T Roberts of the one part William D. Hunter of the second part and Hugh Goodwin of the third part, Witnesseth that where as the said Goodwin is bound as security for the said Roberts in a bond executed to Alfred M Goodwin (date not now recollected) for the sum of four hundred Dollars, and whereas the said Roberts is willing and desirous to secure the said Goodwin against all harm loss or damage by reason of his said securityship. Now this Indenture witnesseth that for and in consideration of the premises and also for and in consideration of the sum of one dollar current money of Virginia in hand paid to this said Roberts by the said Hunter at or before the sealing and every of these presents the receipt whereof is hereby acknowledged. He the said Roberts hath given granted bargained and sold, and by these presents doth give, grant, bargain and sell unto the said Hunter his heirs and assigns forever one certain tract or parcel of land situate lying and being in the County of Louisa containing two hundred and twelve and a half acres, be the same more or less, and is the same land conveyed to the said Roberts by Robert Hurt & wife by deed bearing date on the 13th day of November 1837 and recorded in the Clerks Office of Louisa reference to which deed is made as to the boundaries of said land. To Have and to Hold the said tract of land unto him the said Hunter his heirs and assigns with the appurtenances thereunto belonging or in any wise appertaining free from the Claim ??? of him the said Roberts his heirs or assigns and free from the Claim or Claims of all and every other person or persons whomsoever upon ?? nevertheless that the said Hunter shall permit the said Roberts to remain in quiet and peaceable possession of the said land and ?? the profits arising therefrom to his own use and benefit until the said Goodwin may or shall have to pay the said sum of four hundred Dollars unto the said Alfred M. Goodwin by reason of his securityship in which event it shall be lawful and it shall be the duty of the said Hunter his heirs or assigns to proceed to sell the said land to the highest bidder for cash, on the premises after having given ten days notice of the sale at two or more public places and out of the money arising from such sale first pay all expenses attending the execution of this deed of Trust, and then pay to the said Hugh Goodwin whatever sum he may have had to pay by reason of his said securityship and the balance if any to pay over to the said Roberts his heirs or assigns. But should the said Roberts well and truly pay off and discharge to the said Alfred M. Goodwin the said sum of four hundred dollars when the sum becomes due so that the said Hugh Goodwin shall suffer no ??? loss or damage by reason of his said securityship then the deed shall be null and void otherwise to remain in full force and virtue In testimony whereof the parties to these presents have hereunto set their hands and affixed their seals the day and year above written.

This Indenture made and entered into this 8th day of September 1841 Between Richard T Roberts of the County of Louisa of the first part James D Smith & Michael F Davidson of the second part and John Ellis and David M Hunter of the County of Louisa and Robert S Ellis of the County of Orange of the third part. Witnesseth that whereas the said Richard T Roberts is justly indebted to the said John Ellis and David M. Hunter in the sum of Four hundred & Sixty dollars & eighty five cts by bond bearing date the 5th day of September 1841 and payable on demand and is also indebted to the said Roberts S Ellis in the sum of Twenty four dollars & fifty six cents by bond bearing date the 22nd day of May 1840, and payable on demand and is also indebted to the said Robert S Ellis in the further sum of one hundred & twenty six dollars & thirty one and a half cents by bond bearing date the 30th day of November 1840 – and payable on the sd 30th day of November 1840 with interest thereon from the sd 30th day of November 1840, which last named bond is signed by Thomas I Garnett and the said Richard T Roberts and whereas the said David M. Hunter is bound as security for the said Richard T Roberts to a bond of sixty dollars given to Garrard-Atkins and by said Atkins assigned to Jones & Winston which bond is now in suit in Louisa Circuit Court of Law and Chancery the date of which bond is not now recollected, and whereas the said David M Hunter is also bound as assignor of a bond executed by sd Richard T Roberts to Robert Hart and which bond was by said Hart assigned to said David M. Hunter and by said David M Hunter assigned to Charles S Jones and which sd bond is also now in suit in Louisa Circuit Superior Court of Law and Chancery the exact amount of said bond as also the dates not now recollected – and whereas the said Roberts is also indebted to the said John Ellis in the sum of sixty four dollars & forty five cents by bond bearing date the 24th day of July 1841 and payable the sd 26 day of July 1841 all of which said debts above specified with the interest accruing or that have accrued thereon, the said Richard T Roberts is willing and intends by this deed to secure the payment thereof as also to save harmless and indemnify the said David M Hunter as his security and as assignor as before specified – Now therefore for and in consideration of the premises and also for and in consideration of the sum of five dollars to him the said Richard T Roberts in hand paid by the said Smith & Davidson at or before the sealing and delivery of these presents the receipt of which is hereby acknowledged and confessed by the said Roberts, he the said Richard T Roberts has this day given granted bargained & sold and by these presents does give, grant, bargain & sell unto the said Smith and Davidson their heirs and assigns forever the following read and personal estate to wit one certain tract or parcel of land lying and being in the County of Louisa adjoining Thomas Morris, Henry Harris & others and containing Two hundred and twelve & a half acres be the same more or less – Three bay horses – Three milk cows, five yearlings, one clock, Two guns, one yoke oxen, one oxcart, one carryall & gear all his stock of hogs, sows & pigs, all his household and kitchen furniture of every kind or sort whatever, all his crop of corn wheat oats hay and tobacco now on hand or that he may have on hand at any time before or at the time of closing this deed of Trust – all his plantation tools, implements and gear of all sorts together with the increase of the females of the before named property and his interest in two negroes named Sam & Lydia. To have and to hold the before named real and personal estate together with the increase of the females of the before named personal property unto them the said James D Smith and Michael F Davidson their heirs and assigns forever, free and clear of the claim or claims of him the said Richard T Roberts his heirs and assigns and free and clear of the claim or claims of all and every other person or persons whomsoever. Upon Trust nevertheless that if the said Richard T Roberts shall well and truly pay off and discharge the before named sums of money of Four hundred & sixty dollars & eighty five cts and the interest that may accrue there to the said John Ellis and David M Hunter and the before named sum of Twenty four dollars & fifty six cts and the further named sum of one hundred & twenty six dollars & thirty one & a half cts with the interest that may have accrued thereon to the said John Ellis his heirs or assigns on or before the 8th day of September 1840 and shall also save the said David M Hunter harmless as his the said Roberts security to the bond of sixty dollars before mentioned to Garrard Atkins and by him assigned to Jones & Winston or Jones Winston & Co or FW & JR Jones as may be seen by reference to the bond now in suit in Louisa Circuit Superior Court of Law and Chancery and also as assignor of the bond before described to Charles S Jones and the costs of recording this deed of Trust then this deed shall cease determine and be utterly null and void. But should the said Richard T Roberts his Exor or admn fail to pay off and discharge the before named sums of money with the interest thereon to the said John Ellis, and David M Hunter and to Roberts S Ellis and also to John Ellis their heirs or assigns or either of them or either of their assigns to proceed to sell to the highest bidder for cash on the premises having been first requested so to do by the said John Ellis & David M Hunter, Robert S Ellis and John Ellis or either of them or either of their heirs or assigns Exors or admn & having first advertised the time and place of sale at three or four public places in Louisa County for at least three weeks and out of the proceeds of such sale shall first pay off all the expenses of such sale and of recording this deed then pay over to said David M Hunter any amount he may have paid as security or assignor as before mentioned and described in this Deed should sd Hunter have paid the money for said Roberts with whatever interest may accrue thereon and then the before mentioned sum of Four hundred & sixty dollars & 85 cents and interest thereon to John Ellis and David M Hunter and the sum of Twenty four dollars & fifty six cts and also one hundred & twenty six dolls(sic) & 31 ½ cts and the interest thereon to Robert S Ellis and the sum of sixty four dollars & forty five cents and the interest thereon to the said John Ellis or to their assigns Executors or administrators should there be a sufficiency of assets but should the before named real and personal estate not sell for enough to pay off and discharge all of said debts after paying the before mentioned expenses the proceeds shall be distributed among all the said debts according the their dignity – and if after paying all the purposes for which this deed is given there should be any money remaining the same shall be paid over and restored to the said Richard T Roberts his heirs or assigns. This Indenture made and entered into this 20th day of October 1841 between Richard T Roberts of the County of Louisa of the first part and William Nelson Sheriff of the said County of the second part, witnesseth that whereas three writs of capius and satisfaciendum, which issued from the Clerk’s Office of the Circuit Superior Court of Law & Chancery for the said County, the 1st on the 8th day of October 1841 in the name of John Slater (who sues for the benefit of Charles Ellis & sons) against the said Richard T Roberts of a plea of debt for Sixty dollars and seventy seven cents, with interested thereon after the rate of six per centum per annum from the 1st day of September 1840 to paid; also the sum of six dollars & seventy three cents costs in that suit by the said Slater expended. The second which issued from the said Office on the said 8th day of October 1841 in the name of Charles S. Jones (assignee of David M. Hunter who was assignee of Robert Hart against the said Richard T Roberts of a plea of debt for the sum of sixty seven dollars and fifty cents with interest thereon after the rate of six per centum per annum from the 18th day of November 1838 till paid together with the sum of six dollars and seventy three cents, which to the said Charles S. Jones assignee as aforesaid in the same Court were adjudged for his damages as well by reason of detaining the said debt, as for his cots in that suit expended. The third which issued from the said Office on the 20th day of October 1841 in the name of Francis W. Jones, Philip B Winston Jr & David Anderson Jr late merchant and partner trading under the firm & by the Style of Jones Winston &c. plaintiffs against the said Richard T Roberts of a plea of debt for one hundred and eleven dollars and eleven cents, with interest thereon after the rate of six per centum per annum from the 1st day of May 1841 till paid, together with the sum of six dollars and seventy three cents which to the said plaintiffs in the said Court were adjudged for their damages as well by reason of detaining the said debt as for their costs in that suit expended, all of which said writs have been duly executed on the body of the said Richard T Roberts who is in custody of the Sheriff has surrendered a schedule of his Estate, and taken the oath prescribed for insolvent debtors, and in the said schedule is contained the said Roberts’ Equity of redemption in the property contained in a deed executed by him to James D Smith to secure a debt in said deed mentioned to William Walton which deed bears date the 15th day of May 1838 and was admitted to record upon the acknowledment of the said Roberts, in the County Court of Louisa on the 14th day of May 1838, and I the said deed is conveyed one tract of land lying in the County of Louisa, containing two hundred twelve and a half acres, adjoining the lands of Thomas Morris & others, being the same land on which the said Richard T Roberts now resides as will appear by reference to said schedule and deed. This land is also contained in a deed executed by the said Roberts to William D. Hunter in trust to secure Hugh Goodwin as security for the said Roberts in a bod executed to Alfred M Goodwin for the sum of four hundred dollars, which said deed of Trust bears date the 19th day of September 1838, and is of record in the Clerk’s Office for Louisa County. The said land is likewise contained in a deed executed by the said Roberts to James D Smith & Michael F Davidson, which deed bears date the 8th day of September 1841 and is of record in the Clerk’s Office of Louisa County. This last mentioned deed was executed as aforesaid to secure certain debts therein named due to David M. Hunter & Roberts S. Ellis. Now this Indenture Witnesseth that the said Richard T Roberts in consideration of the premises and of the tract of land before described and for the further consideration of one dollar to him in hand paid by the said William Nelson Sheriff of the said County of Louisa has & by these presents he the said Richard T Roberts does bargain and sell transfer and convey unto the said William Nelson Sheriff as aforesaid the aforesaid tract of land and its appurtenances so for as he is interested in the same including all equity of redemption which the said Richard T Roberts may be entitled to in the said tract of land. To have and to hold the interest of the said Richard T Roberts in the said tract of land to the said William Nelson Sheriff as aforesaid, for the purposes prescribed by the act of Assembly free from the claim of the said Richard T Roberts and all persons claiming under him. In witness whereof he said Richard T Roberts has hereunto set his hand and affixed his seal the day and year first above written.

Morris are held and firmly bound unto the Commonwealth of Virginia in the just and full sum of Five thousand dollars to be paid to the said Commonwealth of Virginia, to which payment will and truly to be made, we bind ourselves our heirs Executors and Administrators jointly and severally firmly by these presents sealed with our seals and dated this 14th day of June 1848 The Condition of he above obligation is such that whereas the above bound Richard T. Roberts has been duly appointed Constable within the County of Louisa for the term of two years from the date hereof. Now if the said Richard T. Roberts shall well and truly discharge the duties of eh Office of Constable in the said County during his Continuance therein then the above obligation to be void else to remain in full force and virtue.
